HANSON CONSERVATION COMMISSION
MINUTES OF THE PUBLIC MEETING OF APRIL 24, 2007
TOWN HALL, 542 LIBERTY STREET, HANSON, MA


Called to Order at 7:30 PM under M.G.L. Chapter 131, s.40 and the Hanson By-Law 3-13, s.5. by Philip Lindquist, Chairman, in Meeting Room A on the top floor of the Town Hall.

Motion to approve minutes of April 10th, 2007:  Dave Harris

Appointments

Mary Frances Allen, Executive Director of the Housing Authority, Bill Brown and Mike Callahan of Dunham Farms asked to speak with the Commission regarding the drainage issues.  Mr. Lindquist remarked that the Commission is still waiting for an opinion from Andrew Spaefski of the EPA who conducted an inspection in March.  Mr. Lindquist said one of the concerns of the Commission is that the weir in the detention basin is too high.  Mr. Kemmett had taken pictures of the site.  He inquired where the water in the foundation holes would go.  Mike Callahan answered that a retention basin would be dug when the buildings go in.  Mr. Grattan mentioned that there has been flooding on Robinson Street. In conclusion, Mr. Callahan will investigate  what may be the cause of flooding.  Also, he will check the height of the weir, confirm the elevation of the bottom of the detention basin and provide an as-built for the basin.  The catch basins will be cleaned out as well.   

Public Hearings

7:45 PM  Continued Notice of Intent for the Taunton Watershed Pilot Wetlands Mitigation Bank which proposes to create 9.3 acres of new wetlands and enhance 16.2 acres of bog to forested wetlands at the Burrage Pond Wildlife Management Area in Hanson by BlueWave Capital, LLC, 137 Newbury Street, fl 7, Boston, MA  02116 represented by Beals & Thomas, Inc., 144 Turnpike Rd., Southborough, MA  (DEP #SE175-0516) – continued per request of applicant to  5/15/07 at 8:15 PM

Mr. Lindquist said he would draft a letter in response to EOEA’s Attorney’s letter now that the Commission has a response from Town Counsel.  The Commission agreed.

8:00 PM  Continued Notice of Intent for the construction of a single family home with associated utilities, driveway, filling and grading within the buffer zone of a Bordering Vegetated Wetland at Reed Street, Map 33, Lot 14-3 for Nicole and Christopher Ebert represented by Woodward Environmental Services, 95 Spring Meadow Lane, Hanover, MA  (DEP#SE175-0518)

Bill Woodward presented a revised plan demonstrating a reduction in the size of the house, the elimination of the attached garage and much of the grading replaced with a retaining wall.  The driveway access from Reed Street is within the 50-foot no-build zone.  The applicant has proposed mitigation in the form of plantings for the disturbance within the 50-foot.  However, all of the mitigation has been proposed within the no-build zone.

Motion to reconsider the denial of the Request for Variance from the 50-foot No-Build setback:  David Harris

Mr. Lindquist said the project was denied under the local by-law.  Mr. Woodward requested a continuance pending advice from Town Counsel.

8:45 Request for Determination of Applicability to determine whether the work depicted on a Plan of Land Off Ferris Street, Map 007, Lot 0017 is subject to the Wetlands Protection Act for J & G Trust represented by Alan Dias, P.O. Box 314, Monponsett, MA  (New Hearing) – continued per request of applicant to May 15th at 8:30 PM because of a defective abutter notification

Discussions

Whitman Hanson Regional High Schoolsee letter from Sharon LePorte regarding mitigation area  At the last meeting, the Commission had voted to reconsider the denial of the Request for Certificate of Compliance.  The Commission reviewed Ms. LePorte’s letter.  She is monitoring the replication area.  Mr. Lindquist commented that his feeling was that Basin B was adequate except for the weir.  He would like to see the calculations for the pipe along the driveway.  Mr. Sandland is willing to do the work for any repairs.  Frank Schellenger wanted it to be known that he thought that the as-built wasn’t correct and the basin was not according to plan.  He feels that it is a re-charge basin.  (continued on next page)

Phil Lindquist read the letter into the record and the Commission extended their own congratulations.

Letter from Recreation Department regarding abutter notification  
The Recreation Department submitted a letter requesting permission to notify abutters  within 1,000 feet of the work area (the lodge) and directly across the pond.   The Commission decided they would need additional information and invited Recreation to attend the next meeting.

Bay State Gas – repair of existing gas lines on Maquan Street
Bay State Gas submitted plans for maintenance of gas lines along Maquan Street.  Mr. Lindquist went over the site with Carl Aiello of Bay State Gas who will now submit a proposal for erosion control at sensitive areas.

Reschedule May 8th meeting date

Motion to reschedule May 8th meeting to May 15th, 2007 because of possible conflict with Town Meeting:  Frank Schellenger

Community Preservation Act  
Mr. Lindquist had created a spreadsheet demonstrating what the average cost to a Hanson homeowner would be annually for the Community Preservation Act based on varying factors.
